What is the biocide directive (98/8/EC) ?

This is a European biocide directive to limit the marketing of biocidal products to those which are effective and do not pose unacceptable risks. The aim is to ensure a level of protection for humans, animals and the environment. The biocide directive also aims to harmonize the regulations between the Member States of the European Union and ensure the uniqueness of the market.

 

What is a biocidal product?

A biocidal product contains one or more active substances intended to intended to destroy, deter, render harmless, prevent the action of, or otherwise exert a controlling effect on any harmful organism by chemical or biological means.

Which products will be authorized by the biocide directive?

Manufacturers of biocidal products must submit their applications to the rapporteur Member State. Substance evaluation is done primarily at the community level and led to the inclusion or not of these substances on positive lists (called Annex I, IA and IB of the Biocidal Directive 98/8/EC). Subsequently, the authorization of biocidal products will be given at the national level. Only products registered on the positive lists will be placed on the market.

The products will be allowed only if their active ingredients are registered in Annex I or IA of the EU directive, and  if it is proved that their action is sufficiently effective, that it has no unacceptable effects on human or animal health (directly or indirectly, e.g. through water, food...), that it has no effect on the environment and that the appropriate use, storage and transport of the product are provided.

A biocidal product classified as mutagenic or carcinogenic will not be allowed to be marketed to the general public.
